's attorney, Victor Marshall, just sent around a note saying Foy was diagnosed with colon cancer last week. According to Marshall, Foy "is undergoing surgery this morning to remove a section of his intestine. We hope that he will be okay. The prognosis is uncertain."
Foy was chief investment officer for the state Educational Retirement Board; his claims of impropriety have added weight to one of the larger
of Gov. Bill Richardson's administration. Marshall also sends along the following update on Foy's case, which alleges that a
central figure in the scandals
, Marc Correra, has "disappeared."
"We submitted the attached sheet to the Judge. It is the cover page of our complaint from June 16, marked up to show the status of defendants as of October 21, 2009," Marshall writes. The sheet shows that some defendants have appeared in the case (they're checked), while others have gone out of business. And, Marshall writes, "Some of the defendants have disappeared, notably Marc Correra and Anthony Correra, who have left New Mexico and probably the country. Both Marc and Anthony have dodged our process servers."
